While most of us aren’t required to report an arrest or conviction of a misdemeanor offense to our employers, doctors, nurses and others in the medical field are held to a different standard.

A.R.S. 32-3208 requires that physicians and nurses report misdemeanor criminal charges involving conduct that may affect patient safety or a felony to the Arizona Medical Board or Arizona State Board of Nursing within 10 working days after the charge is filed.

While it wouldn’t appear that many of offenses listed would affect patient safety, the following types of misdemeanor criminal offenses and or charges involving conduct listed below are offenses that have been determined to be reportable pursuant to A.R.S. § 32-3208 to the regulatory board within 10 working days after the charge is received or filed:

• Assault and Related Offenses:   This includes, but is not limited to, domestic violence, touch with the intent to injure, intentional touching, striking or contact with another person that is harmful or offensive whether or not injury occurs, battery, abuse, threat of violence or harm to somebody else, threatening and harassment, violation of an order of protection, attempt to do violence or harm, disorderly conduct, criminal damage, illegal possession or sale of weapon, other weapon laws violations.
• Theft and Related Offenses:   This includes, but is not limited to,  larceny, stealing, taking or the attempted taking of someone else’s property without permission, receiving stolen property, identity theft, shoplifting, burglary, embezzlement, looting, robbery, trespassing, intrusion, fraud (theft by deception), criminal conversion, criminal bad check, embezzlement, unlawful entry, trespassing.
• Fraud, Deceit and Related Offenses:   This includes, but is not limited to, identity theft, mail fraud, credit card fraud, insurance fraud, welfare fraud, fraudulent schemes, misrepresentation.
• Abuse, Neglect, Exploitation of a Child or Vulnerable Adult and Related Offenses:   This includes, but is not limited to,  child abuse, elder abuse, abandonment, physical abuse, emotional abuse, extortion, endangerment, mistreatment.
• Sexual and Related Offenses: This includes, but is not limited to, rape, sexual abuse, molestation, unwanted touch, sexual harassment, pornography, prostitution, solicitation, fondling, sex with a minor, incest, statutory rape, abduction, assault with intent to commit rape, indecent assault, contributing to the delinquency of a child involving sexual misconduct, sodomy, indecent exposure, indecent liberties with children, carnal knowledge of children, soliciting or enticing or otherwise communicating with a child for immoral purposes, vagrancy involving immoral or sexual misconduct.
• Drug and/or Alcohol Related Offenses:   This includes, but is not limited to, driving under the influence of alcohol or drugs prescription fraud, theft of drugs, sale of drugs, use of drugs, distribution of drugs, manufacturing, growing, possession of drugs, paraphernalia, public intoxication, liquor law violations.
• Arson and Related Offenses:  Including the deliberate setting of a fire(s).
• Animal Abuse, Cruelty and Related Offenses:    This includes, but is not limited to, causing unjustified injury or death to an animal.
